Right of withdrawal

Most frequently asked questions about right of withdrawal.

What is the policy with regard to withdrawal?

You have a statutory right to withdraw from an agreement concluded with Dokteronline.com within 14 days, without giving reasons. The withdrawal period will expire after 14 days from the day on which you acquire,or a third party other than the carrier and indicated by you acquires, physical possession of the medication requested.

Exclusion right of withdrawal for services

Services are offered via Dokteronline.com. A customer's order consists of 1) a request to the doctor to provide a consultation (=a medical service), 2) a request to the pharmacy to sell and deliver medication (=sale of goods) and the order to Dokteronline.com to arrange all this (=a service).

We are therefore of the opinion that this provision is legally valid and should be retained.

The right of withdrawal does not exist for contracts for the supply of sealed goods by the pharmacies which are not suitable for return (like medication) due to health protection or hygiene reasons and were unsealed after delivery.

Exclusion right of withdrawal for products (medication)

The right of withdrawal does not exist for sealed products (medication) which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

Refund

In the case of a valid withdrawal with regard to services and/or products provided, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least ex-pensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied (by the pharmacy), if the loss is the result of unnecessary handling by you. We will make the reimbursement without undue delay, and not later than:
(a) 14 days after the day we receive back from you any goods supplied by the pharmacy, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel this contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

You shall send back the goods (without prejudice to the fact that they have been sold and supplied by an independent pharmacy) over to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
